GENERAL TERMS & CONDITIONS.
Please read these terms and conditions carefully before placing an order. All terms and conditions advertised on this website will take precedence over any other marketing materials, brochures, leaflets etc. produced by John Lynch Studio (hereinafter referred to as JLS). By ordering any JLS Products, you agree to be bound by these terms and conditions. Please print a copy for future reference.
YOUR STATUS
By placing an order with John Lynch Photography or www.johnlynchstudio.com you certify that:
a. You are legally capable of entering into binding contracts.
b. You are at least 18 years old.
c. You are resident in the United Kingdom
d. You have read, understood and agreed with these terms and conditions
CUSTOMER INFORMATION
Personal data and privacy policy: The personal data (for instance name, address, payment information) you have provided us with will be used for the fulfilment and processing of the contract only. Your data will not be held by us or passed to any third party for any purpose whatsoever.

THE CONTRACT BETWEEN US
Your ORDER constitutes an offer to JLS to buy a Product. However, you will not have any right to cancel a Contract for the supply of any of the Products because the cancellation rights do not apply to the sale of custom-made articles or goods made to a consumer’s specification.
AVAILABILITY AND DELIVERY
The delivery date is dependant upon receipt and confirmation by JLS of all payments which will be required before printing takes place. Because all of our orders are processed as “Cash with Order” then the order is only processed after receipt of payment. The beginning of the delivery time will commence on receipt of payment in advance. Prompt and proper fulfilment by the customer of their obligations will be required so that the delivery period can be observed.
OWNERSHIP OF PRODUCT
Ownership of the Products will pass to the customer only when JLS receives full payment of all sums due.
WEDDING BOOKING DEPOSITS
On booking wedding photography a 10% deposit is payable at the time of booking in order to reserve the wedding date. When the booking has been confirmed a receipt will be given for the booking deposit and an invoice will be raised for full and final payment of the outstanding balance 4 weeks prior to the wedding date.
WEDDING CANCELLATIONS / REFUNDS
If a confirmed wedding booking is cancelled within 6 months of the proposed ceremony a 50% refund of the deposit will apply. If the cancellation is within one calendar month of the proposed ceremony then the deposit is forfeited and will not be refunded. If a confirmed wedding booking is cancelled before the 6 months prior to the wedding a 100% refund of the deposit will apply.
WEDDING VENUE/TIME/DATE CHANGES
If the agreed time or date of the wedding changes after the booking is confirmed, it is the sole responsibility of the client/s to request a WRITTEN ACKNOWLEDGEMENT from John Lynch Studio of the proposed changes.
PRICE AND PAYMENT
The prices of any Products will be as quoted on the JLS website from time to time. These prices include all applicable taxes and delivery costs. The costs for shipment will cover once-only despatch to the delivery address specified by the customer. Price changes are liable to happen at any time, but these will not affect Products for which we have already sent you a Booking Confirmation. The website contains a mixture of Products and it is always possible that, despite our best efforts, some items may on occasion be incorrectly priced. In this event JLS will honour the original price quoted. Payment for all Products must be by credit card (MasterCard and Visa), debit card (Solo, Visa, Visa Electron and Maestro) via Paypal and CASH or CHEQUE WITH ORDER. JLS will send invoices by post or e-mail. By submitting an order the customer agrees to these forms of invoicing. Payments will be due regardless of whether and when an invoice is issued.
COMPLAINTS
Obvious defects in delivered goods must be reported to me within 7 days of receipt. Due to the varying difference in colour monitor calibrations, slight deviations in colour will not be regarded as defects.
OUR LIABILITY
JLS warrants that any Product purchased from its website is of satisfactory quality. Our liability for any Product purchased through this website is strictly limited to the purchase price of that Product. This does not limit in any way all other statutory rights. If the supplied goods are defective or lack warranted qualities, JLS – at its discretion – will supply a replacement or remedy the goods, to the exclusion of further warranty claims by the customer. JLS will be liable for replacement deliveries and work done on subsequently remedying goods to the same extent as for the original goods.
OWNERSHIP, ARCHIVING, PROPRIETARY RIGHTS
Digital data and other imaging objects required for re-use, as well as semi-finished and finished Products, will be retained by JLS beyond the delivery schedule purely for marketing purposes. By placing an order you are agreeing to these terms and consent to JLS using copies of the finished Products in its marketing materials and on the JLS website. Products will be created solely on the basis of the customer’s content-related stipulations in any print data that has been sent. You represent that you have all rights to use, disseminate and publish the data you have sent, in particular with regard to text and photographic material. You are liable for ensuring that the data you supply does not infringe proprietary rights of third parties and that the contents of printed matter do not violate the applicable law. You will indemnify JLS without reservation if claims are asserted against same due to the infringement of the rights of third parties, in particular breaches of copyright, as a result of the use of the data provided by you.
WRITTEN COMMUNICATIONS
Applicable laws require that some of the information or communications we send to you should be in writing. When using its website, you accept that communication with JLS will be mainly electronic - we will contact you by email. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that JLS provides to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
TRANSFER OF RIGHTS AND OBLIGATIONS
The Contract between you and John Lynch Photography is binding on both parties and on their respective successors and assignees.
You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. JLS may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of its rights or obligations arising under it, at any time during the term of the Contract.
ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them represent the entire agreement between JLS and the customer in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between ourselves and the customer, whether oral or in writing. JLS and the customer both acknowledge that, in entering into a Contract, neither party has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between JLS prior to such Contract except as expressly stated in these terms and conditions. Neither of the parties will have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently), and the other party’s only remedy will be for breach of contract as provided in these terms and conditions.
LAW AND JURISDICTION
Contracts for the purchase of Products through the JLS website will be governed by English law. Any dispute arising from or related to such Contracts will be subject to the non-exclusive jurisdiction of the English courts.
